EB-2: Advanced Degrees and Specialized Skills

The EB-2 Visa is for professionals with advanced degrees or individuals with exceptional abilities in their field. There are two key pathways:

  1. A job offer from a U.S. employer requiring an advanced degree or its equivalent.

  2. A National Interest Waiver (NIW), allowing individuals to bypass the job offer and Labour Certification if their work significantly benefits the U.S.

An example of an individual with specialized skills who would qualify for a NIW is a public health expert who comes to the U.S. to help address an ongoing health crisis.

EB-3: Skilled Workers and Professionals

The EB-3 Visa is a versatile category for skilled workers, professionals, and other workers. It includes:

  1. Skilled workers with at least two years of training or experience.

  2. Professionals with a U.S. bachelor’s degree or equivalent.

  3. Other workers performing unskilled labour for which no qualified U.S. workers are available.

Labour Certification is required for this category, which involves proving to the U.S. Department of Labour that hiring a foreign worker will not negatively impact the wages or working conditions of U.S. workers.

EB-4: Special Immigrants

  1. Invest a minimum of $1,050,000 (or $800,000 in targeted employment areas).

  2. Create or preserve at least 10 full-time jobs for U.S. workers.

The EB-1 Visa is reserved for individuals who are at the top of their fields. There are three categories:

  1. Individuals with extraordinary abilities in arts, sciences, business, education, or athletics, who must demonstrate sustained national or international acclaim.

  2. Outstanding professors and researchers with a strong record of scholarly achievement.

  3. Multinational executives or managers transferring to the U.S. within their organization.

This category does not require a Labour Certification, and applicants with extraordinary abilities can self-petition, making it one of the most sought-after employment-based visas.
