Who Qualifies for the L-1 Visa?
The L-1 Visa is available to employees transferring between offices of the same company. There are two main categories:
L-1A Visa for Executives and Managers
For high-level employees responsible for strategic decisions, such as managing teams, directing operations, or overseeing key projects.
L-1B Visa for Specialized Knowledge Workers
For employees with unique expertise about the company’s products, services, or procedures. The knowledge must be so distinct that it’s not easily transferable to others.
To qualify, the employee must have worked for the company outside the U.S. for at least one year within the last three years. The U.S. office must also share a qualifying relationship with the foreign entity, such as being a parent, subsidiary, or affiliate. Like all successful work visa applications, the employer must provide a detailed letter outlining your role, responsibilities, and the importance of your transfer to the company’s U.S. operations. Accurate documentation of employment history, including dates, job titles, and a description of your duties, is essential.
